Homeowner granted setback variance to add bedrooms at 1608 Magnolia Street

The Dyer Board of Zoning Appeals voted to approve a development standard variance allowing a property at 1608 Magnolia Street to retain a five-foot side-yard setback rather than the eight feet required by the R-2 district, enabling a rear addition intended to add bedrooms and a bathroom.

Applicant Scott Toomey, identified in the record and appearing before the board, said he and his family have lived at the address about eight years and need additional space. "All of our bedrooms are too small. We only have one bathroom," Toomey said, adding that he has spoken with nearby neighbors who did not object. Public commenter Kramer told the board that many houses on Magnolia date to the 1930s–40s and that approving the variance would help maintain the block's continuity and allow the family to expand.

Staff confirmed proper notice procedures were followed (legal advertisement, certified mailing, yard sign) and explained the board's authority to grant development standard variances. After public comment, a board member moved to approve the variance and the motion carried; the transcript records assent but does not include a full roll-call tally.
