Vice-Chair Linda Jaramillo opened public comment and a Zoom witness from the Innovation Law Lab read written testimony alleging systemic failures in legal-mail handling at the Torrance County Detention Facility (TCDF). Ian Philabaum said one detained man "attempted to access mail related to his legal appeal but was unable to do so" and that staff failures contributed to missed deadlines and accelerated deportation.
Philabaum read additional statements alleging racial discrimination, including an asylum-seeker's report that a correctional officer told him that "Black Africans are not their priority." The testimony said complaints led to retaliatory treatment — segregation placement, false accusations and reduced access to basic services such as haircuts — and described delays in medical care and other unequal treatment.
The Innovation Law Lab's presentation framed the issues as both due-process violations (failure to deliver court mail, missed appeals) and civil-rights concerns (claims of disparate impact on Black and Indigenous detainees). The testimony referenced specific incidents from prior meetings and asked the county to investigate systemic patterns connecting mail mishandling to deportations.
No county staff or elected official announced a formal inquiry or response during the Feb. 25 meeting. The record shows the allegations were presented as public comment; the commissioners took no immediate formal action on the matter at that session.
