Alexander Hosack, the applicant for 21517 Nottingham Dr., asked the Board of Zoning & Building Appeals to allow an air-conditioning unit to be moved from the rear yard to the side yard, proposing a setback of 5'6" where the code requires 10', a variance of 4'6". John Castele, the board's legal counsel, swore in speakers and noted applicants could accept a vote that night with three members present or wait for a full board. Walter Maynard, Building Commissioner, reported "there were no comments from police, fire, service, or other neighbors."
After hearing the request and noting a letter of neighbor support entered into the record, board member Ms. VanSchoor moved to approve Docket 5-26-06B on grounds of practical difficulty; Mr. Studeny seconded. The roll call vote was Ayes: Mr. Feller, Ms. VanSchoor, Mr. Studeny; Nays: none; Abstain: none. The board recorded the variance as approved. The application cited zoning standard 1117.12 in support of the setback requirement.
