Avon homeowners allowed to install fence crossing drainage easement

At its May 6 meeting the Avon Board of Zoning and Building Appeals unanimously approved a variance permitting a portion of a rear-yard fence to be installed within a city drainage easement at 33259 St. James Trail. Applicants Nicolas and Jennifer Gerborg told the Board the proposed fence runs along the back of the property and crosses an easement that contains two drainage structures.
Board members confirmed that, if the City must access the easement in the future, the homeowners will be responsible for removal and replacement of the fence and that an affidavit agreeing to those terms must be filed with the Lorain County Auditor’s Office. The Board’s record shows the motion passed with an “AYES” all vote. No audience members objected during the hearing.
