Chair William Spence announced the decision after consulting with deputy corporation counsel and apologized for the inconvenience.
Deputy Corporation Counsel Chris Nahulu Nunokawa told the board that "if a reasonable person might miss the ability to testify because of issues with a meeting link on the posted agenda, then that would be in violation of Sunshine Law," while noting the specific circumstances in this case were not definitive. The board, citing the legal uncertainty and public access concerns, agreed to repost all agenda items to a future meeting rather than continue substantive discussion without clarifying the access issue.
The board scheduled the next meeting for June 26, 2026 at 9:00 a.m. and will re-notice and repost the May 29 agenda items for that session. Chair Spence said the board would reconvene the items to ensure members of the public have the opportunity to participate.
