Committee members warned that, under current practice, the register of deeds often records properly formatted documents without reviewing acreage, which could allow unintended parcels to be recorded. One committee member said, "If they get a document that has all the signatures and formatting... they're gonna record it," noting limits on the register's ability to refuse compliant filings.
Presenter (Speaker 3) suggested the county consider a pre-recording check or a routed workflow so deeds that might create parcels below the CSM threshold can be flagged for review before final recording. Staff and other members noted capacity constraints: checking every deed is not feasible, but targeted checks for land divisions (not standard transfers) could be practical.
Members agreed staff will consult the register of deeds and township clerks to develop an implementable procedure that reduces the risk of accidental noncompliant recordings and to report back with recommended changes to the draft ordinance.
