Several landowners at the hearing urged classifying the work as repair instead of reconstruction to limit how much assessments could increase. Tim Schopp and others argued that replacing bowed or failed sections to original condition should be treated as repair and that a repair classification would allow the county to avoid larger reconstruction assessments.
Staff and the surveyor's office responded that past maintenance efforts were ineffective and that, where grade or size would change, the work meets the statutory definition of reconstruction. The surveyor said a 2012 maintenance effort cost about $50,000 and ultimately concluded the drain needed reconstruction rather than maintenance that would be durable.
