Parish cited the state constitution and the election code as the basis for declaring the vacancy and said he would fill the seat under Texas Local Government Code —87.042.
Parish then named and administered the oath to Mark Allen Muir to serve as Lubbock County Commissioner, Precinct 2, for the remainder of the term. Parish told Muir to "please come forward" and conducted the oath at the meeting; court members welcomed the new commissioner.
