Engineer Tom described the standard practice: the developer must provide an engineer's certification that work was completed to the approved drawings and industry standards before the borough will issue a CO or accept transfer of maintenance responsibilities. "They are obligated to to do what they said they were gonna do when they were here before the board," an engineer said, noting the borough has put the developer on notice and is reserving its rights under the development agreement.
Council members also recounted residents' complaints about potholes and paving that cracked after repaving in cold weather; staff said some immediate repairs were being performed and that the developer's engineer must certify compliance before the borough completes official acceptance of public elements or transfers responsibilities to a homeowners association.
