Developer asks council to reimburse sidewalk contribution after replacing sidewalk at 19 Dearborn

A member of the LLC developing 19 Dearborn asked the council to reimburse a $3,333 sidewalk contribution the developer had paid last November, explaining the developer decided to replace the entire sidewalk for aesthetic and safety reasons and would be adding value beyond the contribution.
"We paid into the sidewalk contribution fund $3,333. This was back in November 2025... We have decided to replace the sidewalk in its entirety at a cost… so we just wanted to bring it up to consideration if we can possibly get a reimbursement of that $3,333," said developer Daniel Ebar during the engineer's report.
The borough engineer reviewed the relevant ordinance language and said the council has discretion to make a refund where the ordinance allows contribution in lieu of construction on smaller borough streets; a council member advised formalizing the reimbursement in a resolution once the engineer confirms the work meets borough standards. Council agreed to memorialize the reimbursement at a subsequent meeting once the work is complete and approved by the borough engineer.
