South River authorizes consent to assignment, sublease for borough battery storage agreements with AEP Onsite Partners

The borough authorized execution of a Consent to Collateral Assignment Agreement and a Sublease Agreement with AEP Onsite Partners, LLC to permit assignment of Onsite Partners' rights under prior battery storage, energy storage service and lease agreements (dated October 9, 2020; Phase 1 and Phase 2 ESSA documents). The resolution states the required consent cannot be unreasonably withheld and directs the mayor to execute the documents as attached to the resolution.
The action is procedural authorization to facilitate financing for existing energy-storage arrangements previously negotiated by the borough. The council adopted the resolution as part of the consent agenda on Feb. 9, 2026.
