WESLACO ISD board upholds prior grievance findings and approves “remedy 5” after closed session

The WESLACO ISD Board of Trustees on April 27, 2026 met in closed session to consider a Level 3 grievance filed by Jessica Garcia and Jose Silva and, after returning to open session, voted unanimously to uphold the district’s earlier level 1 and level 2 findings and to adopt remedy number 5.
Board President Mr. Nieto opened the special meeting at 5:38 p.m. and performed roll call. The president announced the board would consider the grievance in closed session under Texas Government Code exemptions, citing concerns about personally identifiable student information in the packet and that the requested remedy involved personnel matters. A representative for administration noted those two reasons — FERPA-protected information for students other than the grievant’s child and potential adverse employment implications — as the basis for a closed personnel deliberation.
Board member Jackie Sustaita moved “based on policy FNG (LOCAL) and based on all of the documents relied upon by the administration in reaching the level 2 decision” to uphold levels 1 and 2 and to accept remedy number 5 as discussed in closed session. Mr. Mark Delos Santos seconded the motion. Sustaita also asked the board to wait for certain documents that had been used in the level 1 and 2 decisions before finalizing aspects of the remedy; a board member noted that Dr. Rivera would follow up on those outstanding materials.
The president called an individual roll-call vote. Each member recorded an affirmative vote and the president announced the motion carried. “This grievance matter is concluded,” Mr. Nieto said, and the board adjourned at about 7:03 p.m.
The board cited the following legal authorities on the record when moving to closed session: Texas Government Code sections 551.071 (consultation with attorney), 551.074 (personnel matters), 551.082 and 551.0821 (student disciplinary and related records). The grievance was filed and processed under district policy FNG (LOCAL). The transcript reflects names and spellings as read on the record during roll call.
