Commissioners table Maple Hill wastewater engineering contract after legal review requested

The Pender County Board tabled a staff request to authorize contracting with Kimley‑Horn for an engineering study of the Maple Hill wastewater plant after commissioners asked for additional legal review and more detailed negotiation parameters.
Utilities Director James Proctor described problems at the Maple Hill plant, noting the UV disinfection system has reached the end of its service life and the plant is experiencing significant wet‑weather infiltration. Proctor said the plant normally sees about 8,000 gallons per day but can spike to roughly 35,000 gallons during major rain events — the plant’s rated capacity is about 42,000 gallons per day. The proposed study would evaluate infiltration sources and options for tertiary treatment, and provide design and permitting support; Proctor said Kimley‑Horn was selected through an RFQ process in which three firms responded.
Commissioners expressed support for studying the system but raised concerns about approving the contract form without legal review. One commissioner moved to table the authorization to the next meeting so the county attorney and staff can negotiate and ensure contract protections; the board approved the motion.
