New state rules require independent audit and public notice before Boerne can raise impact fees

Andrea Houston told the committee that recent legislative changes to the impact-fee framework add procedural steps before a city may increase fees. "An independent financial audit must be performed prior to any increase in an impact fee or the adoption of a new fee and [be] made available to the public 30 days before we have a notice of hearing on any changes in our impact fee plan," she said.
Houston also said land-use assumptions and the capital improvements plan must be available to the public at least 60 days before the first publication of a hearing notice. She added staff will need to arrange an audit that is independent from the city's current financial auditor and that these added notice and audit requirements increase the staff workload associated with any update.
