Local businessman tells Comal County court he was wrongfully arrested and asks for his phone's return

Damon Fogley told the Comal County Commissioners Court during the public-comment period that he was wrongfully arrested by the Live Oak Police Department on Oct. 25, 2025, at his business and that officers took his phone and have not returned it.

“I was wrongfully arrested by the Live Oak, Texas Police Department over 2 months ago on 10/25/2025 at my business in Live Oak,” Fogley said. He told the Court he was at Live Oak City Hall on Oct. 23 trying to file an ethics complaint and later was arrested on an affidavit that accused him of trespassing and other misconduct he says is unsupported by evidence.

Fogley said he has tracked his phone to the Comal County Sheriff's Office and believes someone accessed its contents while he was jailed. “My phone was last tracked at the Comal County Sheriff's Office,” he told commissioners, and said he has screenshots from his Samsung account showing access. He said he has raised internal affairs complaints against Live Oak officers and that body‑cam footage of his arrest has not been released to him or his attorney.

Fogley asked the Court to accept his contact information so county staff or others could follow up. The County Judge asked commissioners to accept the handout of contact details. The Court did not take immediate action on the claim during the meeting.

The comment came during the public‑comment portion of the Dec. 30, 2025, commissioners court meeting. No sheriff's office or Live Oak official response was offered on the record during the hearing; the claim and any supporting evidence were not independently verified in the meeting record.
