The Town Board on Dec. 8 adopted Resolution #102 to waive conditions placed by the Planning Board in its Dec. 16, 2024 approval of the Buttermilk Falls Hotel and Resort expansion. The waived conditions had required an Offer of Cession conveying ownership of certain lands on North Road to the town; the Town Board recorded that it "does not wish to take title to the property described."
The resolution cites the Planning Board's prior conditional approvals and specifically waives the provisions listed in the earlier resolution (I(iv)(b) and II(A)(d)(i)). The board voted unanimously to approve the waiver. The action removes the town as the intended recipient of the cession and clears that condition for the applicants, 220 North Road, LLC and Robert Pollack, as the project moves forward under the Planning Board approvals.
