The Village of Maybrook Board of Trustees on Feb. 2, 2026 reaffirmed its Jan. 5, 2026 finding that the structure at 212 Homestead Avenue is unsafe and adopted a resolution ordering the building demolished.
Attorney Liz Cassidy summarized the enforcement steps taken to date — personal service by process server, certified mail and posting on the property — and said the owner was provided due process. The board’s resolution, passed unanimously, sets a boarding deadline of Feb. 9, 2026; requires a demolition permit be obtained within 30 days (by March 4, 2026); and requires demolition to be completed within 90 days (by Monday, May 4, 2026).
Robert Rowe, who identified himself as an owner of the property and attended with his spouse, apologized to the board and requested 90 days to complete the demolition, citing logistics with utility coordination (Central Hudson) and financing. Building Inspector Tim Ippolito told the board that asbestos and lead surveys and the contractor’s required insurance will be needed before demolition permits are issued; Rowe said he has the reports. Attorney Cassidy said the board may grant an extension as a business decision and suggested using a tiered process to streamline future decisions.
The Board voted to reaffirm the unsafe‑structure determination and adopt the schedule in two separate motions: the reaffirmation motion (Deputy Mayor Charles Woznick moved; Trustee William Treco seconded) and the schedule motion (Trustee Daryl Capozzoli moved; Trustee William Giannico seconded). Both motions passed 5 Ayes, 0 Nays. The owners were given the opportunity to present information and were notified of the timelines established by the resolution.
Next steps: the owner must secure required environmental reports and contractor insurance for the permit application; failure to comply by the deadlines could prompt municipal enforcement action under Chapter 81 of the Village of Maybrook Code.
