The Jefferson County Board of Zoning Appeals unanimously approved a Developmental Standards Variance on June 2 allowing a 30-foot variance from the center of the road so applicant Jared Kirby may build a 30' x 40' pole barn at 8484 E S.R. 56, Vevay, in Milton Township (parcel 39-11-07-000-007.001-008). President David Ferguson and members Fred Stilwell and Larry Wynn voted 3-0 to grant the variance with no attached conditions.
Kirby told the board the property "is a small parcel and only has a small section of flat ground that is available to be a building site and is just asking the board for a thirty-foot variance to utilize the flat ground for a pole barn to be built." He said the requested variance is driven by the grade at the rear of the lot, which limits buildable area. Board discussion included a site-observation comment from Mike Pittman, who said he had driven past the property and noted neighboring houses sit closer to the road than the proposed building site.
The board read and recorded three Findings of Fact required for a Developmental Standards Variance. Each finding was affirmed by a recorded 3-0 vote: (a) approval will not be injurious to public health, safety, morals and general welfare; (b) the use and value of adjacent property will not be substantially adversely affected; and (c) strict application of the ordinance would cause practical difficulties in using the property.
A motion to approve the Developmental Standards Variance was made by Larry Wynn and seconded by Fred Stilwell; the motion passed unanimously, 3-0. The minutes record the action as an approval of the variance and list no conditions on the approval. The board also documented that green cards and proofs of mailing for the application were turned in by the applicant.
The decision is recorded in the official minutes of the Jefferson County Board of Zoning Appeals; any party seeking to challenge or appeal the variance should consult the county's established appeal procedures. The board adjourned following completion of business.
