"Given the circumstances, we think a 50% compromise is reasonable," staff said. The chair moved to grant a 50% refund; after a roll call the board approved the refund unanimously.
The withdrawal removes the need for a variance; the refund decision was recorded as a one-time administrative compromise in the hearing record.
