Kingen said the filing is intended to “clean up” the development statement, remove heavy‑truck sales and introduce an enforceable plan of operation and recordable commitments.
Staff expressed concern about past removal of vegetation without a tree preservation plan and about incomplete records of permits for existing site improvements. Given unresolved questions about prior enforcement and the need for a plan to address outstanding issues, the examiner granted a continuance to allow the parties to produce documentation and a remediation plan.
Next steps: SRMK Realty agreed to the continuance; staff and petitioner will research permits and provide updates for the August 13 hearing.
