Lanark to consider ordinance on telecom use of rights-of-way after provider letter

Members characterized the correspondence as a generic form letter that did not appear tailored to Lanark’s situation and noted the city has not proposed a franchise fee or similar charge that the letter seemed to assume.
City attorney Ed Mitchell advised the council to place a proposed ordinance on the next council agenda for consideration; he emphasized that placing an ordinance on the agenda would not require immediate adoption. In the discussion council members raised the court case AT&T v. Village of Arlington Heights as a reference point while noting they believed Lanark’s circumstances differ. No ordinance was adopted at the June 2 meeting.
