Moira adopts Local Law No. 3 to exceed state tax-levy limit for 2025 budget

The Town of Moira adopted Local Law Number 3 of 2024 on Nov. 12, 2024, allowing the town to levy property taxes in excess of the limit set by General Municipal Law §3-c so the board can pass a 2025 budget that requires a higher levy. The motion to adopt the law was made by Councilman Adam Deuyour and seconded by Councilman Justin Robinson.
The law’s text states, "It is the intent of this local law to allow the Town of Moira to adopt a budget for the fiscal year commencing 2025 that requires a real property tax levy in excess of the ‘tax levy limit’ as defined by General Municipal Law § 3-c." The board directed the Town Clerk to file the local law with the New York State Secretary of State; the law takes effect upon filing.
The adoption passed with four votes in favor and one abstention (Trimm-Abstain; Snyder-Aye; Deuyour-Aye; Robinson-Aye; Niles-Aye). Supervisor Chad Niles said the override was necessary based on the board’s budget planning and public hearing comments heard on Oct. 22, 2024. The measure gives the town the legal authority to set a levy above the statutory cap for the coming fiscal year.
