Elko CAB asks commission to shift proposed trail-camera ban later, flags enforcement and penalty concerns

At a CAB meeting, members reviewed proposed regulations from the Emerging Technology Committee that would prohibit possession of trail cameras, thermal imaging and rangefinders during a summer–winter window. The board voted to ask the commission to consider making the prohibited time frame August 1 through December 31 instead of the draft’s July 1 start.
"My interpretation, Justin, would be a full unlawful possession during those days," Jason Jackson, a game warden with the Nevada Department of Wildlife, said during the discussion, arguing that the way the draft is worded would make mere possession illegal during the prohibited interval. CAB members expressed concern that the July 1 start leaves only a narrow period after draw results for sportsmen to use trail cameras.
Members debated penalties proposed in the draft, including raising demerits for violations (examples discussed: from 3 to 12). Jackson said moving demerits to 12 would likely deter repeat violations but acknowledged enforcement challenges: most use happens at night when wardens are not present.
One CAB member said a monetary fine paired with demerits might better deter out-of-state users who are unaffected by license revocation. After discussion, the board moved and approved a recommendation that the commission consider an August 1–Dec. 31 prohibited period and review penalty structure.
The CAB recorded the recommendation as guidance to the commission; the draft regulation will proceed through the Emerging Technology Committee and the full State Wildlife Commission for public hearings and possible future action.
