County attorney summarizes two Court of Appeals decisions affecting local cases
Summary

County Attorney Bin Minter updated the board on two recent Court of Appeals rulings that bear on ongoing county litigation.
Minter summarized that in UGOCCC v. Damon Hoyte (Superior Court Case 23CV072) the Court of Appeals reversed the Superior Court’s decision and reinstated the magistrate court’s original ruling concerning a 2022 zoning-ordinance violation and related fine. Minter said the county had appealed the Superior Court order that previously required refunding collected fines to Mr. Hoyte and allowing a retrial in magistrate court; the Court of Appeals’ opinion reversed that Superior Court order.
Separately, in Melissa Haymond v. Hoyte (in which the county is a co-defendant), Minter said Ms. Haymond had filed a motion to dismiss that the Superior Court denied and that the Court of Appeals subsequently vacated that denial and remanded the case to Superior Court. Minter told the board the county’s motion to dismiss in that case remains pending in Superior Court.
Why it matters: the rulings affect the status of fines and pending litigation involving a county commissioner and the county as a codefendant, and they may affect the county’s exposure and next legal steps. The board did not vote on any litigation matters in open session; Minter stated that the closed sessions addressed legal issues within open-meetings exceptions.
