Commissioners give county manager authority to complete Brush Creek roundabout land deals

The Gunnison County Board of County Commissioners on July 21 adopted Resolution 2026-24, which delegates to the County Manager the authority to negotiate and execute contracts, easements and other instruments necessary to acquire or transfer land for construction of the Brush Creek roundabout in the Crested Butte area. The delegation covers temporary and permanent easements, transfers of land interests, and agreements with governmental and private entities needed to develop and finance the roundabout and related trail and transit features.
County Manager Matthew Birnie and Assistant County Manager for Public Works Martin Schmidt told the Board that reauthorization and ratification were required because federal funds are involved. Birnie said the reauthorization relates to federal requirements from the Uniform Relocation Assistance Real Property Acquisition Policies Act of 1970. The resolution expressly ratifies prior actions taken since January 2023 related to the property and instructs the County Manager and staff to consult the County Attorney for legal sufficiency on executed documents. The Board approved the measure unanimously (Houck yes; Smith yes; Puckett Daniels absent).
The resolution states the Brush Creek roundabout will serve motor vehicle traffic, provide a trail connection from Crested Butte South to the Town of Crested Butte, include a transit stop and trail underpass, and is tied to the Whetstone community housing project. It authorizes the County Manager to proceed with necessary land transfers, easement negotiations and financing steps and confirms that prior inconsistent orders are repealed to the extent of inconsistency.
