At the April 3 meeting planning staff explained that Ordinance 2025-3 would make warehouse uses more restrictive by reverting to pre-2022 standards. Staff (Scott Maldonado) told commissioners that under the proposed change only two properties would remain available for development under the prior standards: a property identified as HSS (under a settlement agreement) and the Yorlet property (currently involved in court proceedings).
Commissioner Randy Duncan raised concerns that future litigation over the ordinance — whether the township prevailed or not — could be costly. Commissioner Doug McDonald described the situation as difficult for the township. On a McDonald/Sandys motion the Planning Commission forwarded Ordinance 2025-3 Revising Warehouses Use to the Board of Supervisors with no recommendation; the motion carried with Commissioner Randy Duncan recorded as opposing the motion.
