The motion, made by Timothy McCormack, Esq., Public Member, and seconded by Nicholas Haar, PharmD, R.Ph., proposed that the consent agreement include: an admission to a violation of 32 M.R.S. § 13742‑A(1)(C) and Board Rule Chapter 30, Section 1(15); a formal warning; a $250.00 civil penalty; and three hours of continuing education focused on avoiding misfills. The motion was recorded as Emmons and Hamilton in favor; Ahmed, Kane and Norberg absent.
Other complaint files heard that day were handled differently: 2026‑PHA‑21209 was tabled for further investigation; 2026‑PHA‑21302 was tabled to another meeting because of lack of quorum; 2026‑PHA‑21303 was dismissed with no evidence of a violation; and 2026‑PHA‑21333 was dismissed with a Letter of Guidance reminding a licensee of Board Rule Chapter 13 (6)(6).
