The Calvert County Planning Commission on May 20 deferred action on MSD FP 138189, a request to remove intrafamily transfer restrictions on Old Anchor Farm lots, after staff and the applicant clarified which parcels were affected.
Planner Jay Cousinau explained that the subdivision plat was recorded July 29, 2021 and that the ordinance (Calvert County Zoning Ordinance, Article 8‑1.05.h) allows subsequent conveyance outside an immediate family only where specific conditions are met, including a demonstrated change in circumstances and payment of transfer‑development rights (TDRs) or equivalent to the county purchase and retirement fund. Cousinau said the commission could approve with conditions, approve with modifications, defer for more information, or deny the request.
Commissioners questioned precedent and whether a similar request had ever been granted; Cousinau and another participant said they were not aware of an approved case under the current ordinance. After an exchange about which lots were at issue, the applicant's agent, Jeffrey Toole, clarified that the intra‑family transfer applied to lots 3 and 4 and that only lot 3 is currently developed. Commissioner Patricia Gadway moved to defer "to send it back to staff to bring us the proper information to work with COA Barrett" and the motion carried on voice vote.
The commission’s deferral directs staff to return with corrected materials and clarified lot numbering before any formal action is taken. No final determination on removing the intrafamily designation was made at the meeting.
