Nevada EMC adopts revised rules to speed grievance hearings; agencies can file pre-hearing motions to dismiss

The Nevada Employee-Management Committee on Oct. 17 adopted revised Rules of Practice proposed by the Division of Human Resource Management, changing how grievances at step four are processed. Nora Johnson of DHRM told the committee that "grievances submitted to step four will now automatically be scheduled for hearing," and that agencies would be able to file a motion to dismiss ahead of the hearing so the committee can rule on jurisdiction at the outset.
Supporters said the change is intended to reduce repeated denials and re-litigation requests after agendized, nonbinding discussions. The revisions reflect statutory terminology updates from Senate Bill 431 and rename internal units to Consultation, Accountability and Regulations. Member Ava Case moved to adopt the revisions; Sandie Geyer seconded and the motion carried by voice vote. The committee discussed scheduling constraints and emphasized that motions to dismiss will be agendized so the full committee can act on them at a hearing.
