Town Attorney Mike Hyman and staff presented an ordinance to structure financing for construction of Fire Station 156 and an associated logistics facility; council voted to introduce the ordinance by title and set financing parameters.
Hyman said the project is "approximately a $20,700,000 project, given all the improvements," and explained the recommended financing structure: the town would issue up to $8,300,000 in tax-exempt certificates of participation (COPs) as the primary funding source, supplemented by interfund loans, $6,000,000 from TABOR surplus and $5,000,000 from the general fund, with the remainder from fund balance and the Fire Capital Fund (impact fees). He outlined parameters including a lease term not to extend beyond Dec. 31, 2055, a maximum aggregate base rental amount not to exceed $8,300,000, a maximum annual repayment amount of roughly $725,000 and a maximum total repayment (principal and interest) not to exceed $17,000,000. He also noted a maximum net effective interest rate parameter of 5.25% was included as an upper bound, with staff aiming to secure better market rates.
Council members asked about long-term costs and compounding. Mayor Pro Tem Cavey pressed whether interest compounds and Hyman confirmed it does; Council Member Brooks asked for clarification on whether $725,000 was a strict cap on annual payments or a base rental with the option to prepay additional amounts. Hyman responded that $725,000 is the "maximum base rental" and does not include prepayments.
Staff described the financing as a lease-leaseback structure using a trustee and COPs to allow the town to finance the facility while preserving annual appropriation authority. The motion to introduce the ordinance by title passed on a unanimous roll-call vote.
