Council appeals childcare conditional-use permit and flags screening and parking concerns on Lewis Center tentative map

Council pulled items 5A (tentative map) and 5B (childcare conditional use permit) to seek stronger assurances about property screening and parking. Mayor Greg Newton and staff reviewed the project's history, noting earlier conditions requested by some commissioners for screening and fencing to mitigate views for neighboring residents. Interim Community Development Director Mark Tomich said the commission requested fencing/screening and that he would confirm whether that condition carried forward to the CUP.

A key procedural point arose about whether a tentative map can legally carry development-standard conditions such as parking or screening; city staff and legal counsel explained that a parcel/tentative map generally takes infrastructure conditions (sewers, streets) while a conditional-use permit is the appropriate vehicle for development-standard conditions. Council also reviewed a parking baseline (initially 617 spaces, later amended to 565) and asked for a parking analysis to confirm the developer's verbal commitment to meet earlier provisions. The council discussed possible recusal for a council member with childcare business ties; the city attorney explained the recusal test is whether a decision would have a reasonably foreseeable material financial effect on the member. After discussion, the council moved to appeal item 5B and the motion passed unanimously.

Council requested legal feedback on whether screening could be added to the parcel/tentative map, and staff said the parcel map would return to council for added conditions as needed. No final determination about recusal was recorded; city staff said the member could listen to facts and disqualify if a conflict is later found.
