The Plan Commission approved a conditional‑use amendment (CU26007) on Aug. 4 allowing continued single‑family residential use and site improvements at 1709 Barton Avenue for Christopher and Karen Callan. Staff said the property is zoned B2 (commercial) and that a conditional‑use permit is required because the use is nonconforming following annexation; the property has historically been residential.
Staff and applicant explained proposed improvements include a new garage, fence, deck and shed. Because the proposed garage and the existing shed together would exceed the city's 720‑square‑foot accessory‑structure limit, staff recommended as a condition that one of the two structures be reduced or removed prior to building permits. After a public hearing in which a nearby neighbor, Jeff Slice, spoke in favor of the owner’s ability to build a garage, the commission voted to approve the amendment with the staff‑recommended condition.
Commissioners confirmed the applicant had been advised of the size limitations during initial staff meetings and that approval represented a formal amendment to the original, grandfathered conditional use. The approval was carried by voice vote.
