Staff proposed separating nightclubs from bars and taverns, saying nightclubs — defined as facilities providing alcoholic beverages with live entertainment after 10 PM — would not be permitted in the downtown master plan area, while bars and taverns could operate as permitted uses through 10 PM and would require use permits for later hours.
The presenter read the proposed nightclub definition and explained distinctions between eating/drinking establishments, live entertainment and a nightclub. "The proposed definition of a nightclub is a facility serving alcoholic beverages for on‑site consumption and providing live entertainment," staff said, adding that live entertainment would be permitted indoors through 10 PM when other regulations are met.
Staff also described an annual, automatically granted temporary amplification relief for two holiday evenings — the night of Dec. 31 into Jan. 1, and the night of July 3 into July 4 — allowing amplified sound until 12:30 AM subject to the noise ordinance and other master plan parameters. The presenter noted that other special events can still petition the council for one‑time relief.
A commissioner asked whether the temporary relief is automatically granted or requires a use permit; staff answered the annual relief would be granted via the master plan so a separate petition would not be required for those two evenings.
