Planning board discussion on short-term rentals referred to select board; resident seeks clarity

Planning Board Chair Bob Craycraft summarized recent town-counsel guidance that any approval for short-term rental use "runs with the land," and said the select board is examining whether regulation can proceed via a public-health ordinance. Board members agreed the select board may take the lead and that some matters could return to the planning board for input or for items that require legislative action.
"...any approval runs with the land," Craycraft said when reviewing the counsel memo. He said the select board is "looking into... what they want to entertain for a rule that they can put forward, or ordinance via the selectmen, based on the health issues."
Resident Terry Jarvis, who addressed the board during the meeting, asked how the planning-board draft would relate to the legislative process and whether planning-board work would ultimately go before the governing body. "I'm Terry Jarvis, and I live on Main Street. And I'm wondering how the process will go since it appears that the planning board is not going to be writing ordinances for short term rentals," Jarvis said.
Board members repeatedly noted that counsel and the select board will shape enforcement details, grandfathering, and whether permits may be revoked; no ordinance was adopted or scheduled for vote during the meeting.
