Council authorizes land acquisitions and eminent-domain authority for drainage and sewer projects

For the Neighborhood 5B Oakland Drainage project, senior real-estate specialist Angel Delorey said the city needs about 10.416 acres plus roughly 1.283 acres of temporary construction easement to build a regional detention pond that consultants estimate could remove about 57 acres from the floodplain; construction is planned to begin in calendar year 2027 with estimated completion in 2028. Council authorized acquisition and eminent-domain authority after a motion and second; the vote was 7-0.
For the North Moss Branch sewer extension, deputy director Deanna Cody said the project (about 9,000 linear feet of sanitary sewer) is in the wastewater master plan and will be advanced to leverage cost-sharing with developers; staff requested authority to acquire remaining permanent and temporary easements and eminent-domain authority if necessary. Council approved the request 7-0.
Next steps: staff will make bona fide offers required by state law and negotiate acquisitions; if negotiations fail, the city attorney may file eminent-domain proceedings.
