Hearing officer recommends approval of Huachuca City zoning change for firearm-related home businesses

Dr. Johnson, the town's hearing officer, opened a Feb. 19 public hearing on proposed text amendments to Huachuca City's zoning code and recommended the Council adopt the changes.
"I'm doctor Johnson, this town's hearing officer," he said as he introduced the item and explained the public-notice and citizen-review process surrounding the amendment. He said the amendments are intended to align Section 18.100.210D(1) with state law governing firearm-related home-based businesses and to clarify prohibited uses. Staff reported that "to date, there are no written comments, no phone in comments of any kind has been submitted."
During the hearing, Dr. Johnson read the proposed wording aloud. He read in part: "The operation of a home based business involving the sale, mail order, trade, manufacture, display, storage or repair of any sort of explosive or improvised explosive device, and or prohibited weapons, as defined under ARS Section 13-3101." The language in the draft identifies explosives and "prohibited weapons" under ARS Section 13-3101 as barred uses for home-based businesses in town zoning.
Dr. Johnson said the draft amendment and related materials were posted at appropriate public locations and on the town’s Facebook page and that a citizen review process began Feb. 5 to allow public questions and comments. When he opened the hearing for in-person public input, he noted only three people were present in the chamber (the hearing officer, Town Clerk Brandye Thorpe, and Chief of Police Wyatt Barry) and that no members of the public addressed the panel.
At the conclusion of the hearing Dr. Johnson announced, "It is my recommendation to approve the amendment as written. This will be sent on to the Council for them to make the final reading." The hearing was then adjourned. The minutes of the hearing were later certified and include the mayor's approval signature dated Feb. 26, 2026.
The Council has not yet voted; the hearing officer's recommendation will be considered at the Council's final reading. No substantive testimony for or against the amendment was received at this hearing.
