The Buncombe County Board of Adjustment on Feb. 12 approved a variance (ZPH2024-00037) allowing the reduction of minimum lot-size requirements for a portion of a parcel at 610 Buckeye Access Road, permitting a 0.35‑acre nonconforming lot. Staff presented the request and noted that the parcel currently contains multiple structures and that the applicants applied on Sept. 9, 2024. The board adopted findings of fact that the hardship results from conditions peculiar to the property and not from applicant actions.
Family members representing the estate described the hardship. "My father, Benjamin Grady Spivey junior... unexpectedly passed 08/07/2021 with no will," one applicant said, explaining that joint ownership left heirs unable to separate uses without a lot split. Applicants confirmed existing, independent septic systems; a witness, Jamie Cox, added that separate boundaries would ease insurance liability concerns. After board discussion of comparable preexisting lots on the street and septic containment, the board voted to approve the variance and directed staff to prepare the order for execution.
