The Ben Bolt-Palito Blanco Independent School District Board of Trustees voted on Dec. 11, 2025 to adopt a resolution authorizing contingent-fee legal services to pursue recovery of insurance proceeds related to hail damage from the Nov. 1, 2025 storm. The motion to adopt the resolution was made by Marcos Garcia, seconded by Debby Garza, and carried by a 6-to-0 vote.
The resolution includes the findings required under Texas Government Code Chapter 2254, Subchapter C and directs staff to submit the contingent-fee agreement for review by the Texas Attorney General as required. Board members discussed legal strategies and possible litigation during a closed executive session earlier in the meeting; the open-session action authorized pursuing insurance coverage claims using a contingent-fee arrangement rather than an hourly-fee contract.
In a related vote, the Board approved entering into a contingent-fee legal services agreement with Nick Maddox & Associates, PLLC to represent the district in insurance coverage litigation and related claims arising from the hail damage. That motion was made by Debby Garza, seconded by Jonathan Garcia, and carried 6-0. The board record does not specify the fee percentage, retainer or other financial terms; those details will be included in the agreement submitted for Attorney General review.
