Solicitor advises waiting on bamboo ordinance changes pending state law

Solicitor Facenda told the council the State of New Jersey has passed legislation addressing invasive species that includes running bamboo and that the state provision could supersede local ordinances. He recommended keeping Northfield's bamboo ordinance unchanged until the state law becomes effective and advised that enforcement between now and then be left to the Code Enforcement Officer's discretion.
Clerk Mary Canesi asked whether Code Enforcement will continue to enforce the local ordinance in the interim. Facenda said enforcement should be left to the officer's judgment. The council did not adopt or amend local code at the work session.
