The presiding officer reviewed materials added to the case file — including the original site plan and a 1995 resolution — and asked staff to check for any action amending the site plan or approving removal of the access. Planning staff reported they did not find evidence of such a permit in their records; the fire-prevention representative likewise said the emails and records they had were included in the packet and produced no confirming record of a decommissioning permit. The board said it could provide the relevant minutes and documents upon request through the law department.
Staff noted some historical uncertainty about how older approvals were handled and suggested differences in code cycles or building-construction types could explain variation among older sites. The board instructed staff to continue to work with the owner and said it will issue a written order that the owner may appeal.
