On Aug. 4 the City Council approved on first reading an amendment to the Land Development Code (sections 12‑40 and 12‑81) to adopt the statewide definition for certified recovery residences and to formalize a reasonable‑accommodation review procedure aligned with state law.
Senior Planner Alyssa Livingstone told council the amendment clarifies definitions and sets administrative timelines: staff may request additional information within 30 days of filing and then the applicant has 30 days to respond; once deemed complete the city has 60 days to issue a final determination and failure to meet that deadline can result in a deemed approval unless the parties mutually agree to extend. "If approved, this text amendment will adopt the statewide definition of certified recovery residences," Livingstone said, and staff emphasized the change implements state mandates rather than creating new zoning prohibitions. The amendment was scheduled for second reading and public hearing on Aug. 17.
