Council hears updates on nuisance violations; prosecutor fines property owner $1,500 for nonappearance

Council received multiple updates on code-enforcement and nuisance cases at the May 19 meeting.
Town Attorney Jeff Slothower told council the prosecutor reported Higginbotham was fined $1,500 for not appearing in court and might be subject to a criminal charge if non-compliance continues. Slothower also said the Higginbotham nuisance cannot be converted into a lien against the property unless the Town first abates the nuisance and the court then moves the matter to collections.
Council directed staff to follow up with the prosecutor on a 45-day progress check regarding a Notice and Order to Correct Violation issued to Adcox at 608 Washington. Separate violation notices for Hougardy (608 Garfield) and Dan Rush (402 Washington) were delivered on May 12, 2026; staff noted Rush requested in-person pickup so his notice was not mailed. No formal enforcement votes were taken at the meeting.
