The board returned from closed session and discussed the Diamond Chip (DCR) matter. Ken reported the applicant's counsel emailed to proceed with application number 689 and that Judge Minkowitz's order requires the matter be heard within 45 days. The board determined new public notice is required because the matter dates back to 2023–2024 and moved to schedule a jurisdictional hearing for the 09/02/2026 agenda.
The motion was seconded and passed on roll call. Board staff were directed to confirm agenda placement and coordinate any conflicts (the Highland matter may conflict and, if necessary, the DCR matter would be scheduled for 08:15 p.m. on that date). The board noted the applicant may request more time but that, absent that request, the court timetable applies.
