The city attorney explained the Office of Family Services and the city attorney's office concluded state regulations preempt the city's special-permit requirement for residential family daycare uses, so the proposal would make them a permitted accessory use rather than a use that requires a local special permit.
"This proposed amendment eliminates that special permit requirement," the city attorney (speaker 7) said, adding that some circumstances could still trigger site-plan approval and that state approval and compliance with fire and building codes remain required. The council closed the hearing after receiving no public comment; the local-law referral will go to the planning commission for review and recommendation as part of the normal process.
