The Board of Adjustment approved Case 26-2961-VAR, permitting a swimming pool at 2905 Patriot Drive to be placed 15 feet from the rear property line — a 10-foot reduction from the 25-foot requirement. Staff told the board that the house placement and site topography constrained usable yard space and that the pool location would not encroach on a recorded utility easement. Notices were mailed to 11 addresses with six returned in favor and none opposed.
Applicant Carlos Acosta told the board that the lot’s topography and existing fence made the proposed location the only practical spot to build a pool. After board questions and review of the packet, a motion to approve the variance was made and seconded; the motion passed unanimously. "The requested change is a 10 foot reduction in the required rear setback," staff told the board during the presentation.
