The Tuloso-Midway Independent School District Board of Trustees voted Feb. 17 to authorize the use of eminent domain to acquire 1,742,400 square feet of surface estate from a tract recorded to Braman Ranches LLC for the purpose of constructing a junior high and related educational facilities. Leo Gonzalez moved the resolution; Rick Chapa seconded it and the motion passed 6–0.
Leo Gonzalez moved, "I move that the Tuloso-Midway Independent School District authorize the use of the power of eminent domain to acquire the surface only of a tract of land more accurately described as 1,742,400 sq. ft., more or less, out of the surface estate of a tract of 869.348 acres of land known as 'Tract Five' (52 Farm) described in a deed to Braman Ranches LLC. as recorded in Document No. 2009000322..." The resolution authorizes administration to negotiate purchase at market value established by a state-certified appraiser and gives legal counsel authority to initiate condemnation proceedings if necessary.
The board’s action followed a closed-session consultation with legal counsel under Texas Government Code Sections 551.072 and 551.071, as noted on the meeting agenda. The resolution references the parcel as being out of the Artemus R. Roberts subdivision and recorded in the official public records of Nueces County.
