Deputy County Counsel Matthew Gudrowski responded that the Planning Commission does not adjudicate conflicts of interest: "The Planning Commission is not the decider of any disputes related to a potential conflict of interest. That's a matter for the Fair Political Practices Commission." He also stated Ms. Jones' comment letters indicated she submitted remarks as a member of the public and not in her capacity as a commissioner, which limits the commission's ability to treat those letters differently than any other public comment.
No formal recusal or enforcement action occurred at the hearing; counsel said the matter would be within the FPPC's jurisdiction if a formal complaint were filed.
