Oklahoma Corporation Commission adopts emergency rule amendments to OAC 165:5, cites new statute

Tracy Case, deputy general counsel for the Oil and Gas Conservation Division, presented proposed emergency amendments to OAC 165:5 and opened the floor for public comment; no public comment was offered in person or online. Case recommended the Commission determine the rulemaking to be an emergency measure under 75 O.S. § 253(A)(1) because of the recent enactment of 17 O.S. § 180.31, and Commissioner Kim David moved and called for a vote on that motion.
The Commission voted unanimously to find the rulemaking necessary as an emergency and then, after another motion, unanimously adopted the emergency rules filed June 23, 2026, authorizing their submission to the Governor. The minutes record the votes as Commissioner David Aye; Commissioner Hiett Aye; Commissioner Bingman Aye.
