Respondent says contractor admitted cutting beyond permit; association to seek reimbursement

A woman who identified herself only as Rita spoke for the respondent at the podium and said the contractor who performed the dune trimming "acknowledged it" and had told her he would attend but did not appear at the hearing.
"I called him about it. He acknowledged it. And he did say that he got busy and turned his head," Rita said, describing the contractor’s response. She told the magistrate she planned to require the contractor to cover any costs assessed by the town.
The town, however, presented photographs and testimony indicating the trimming extended onto town-maintained right-of-way. The magistrate found the trimming to be an irreversible violation and imposed a $5,000 fine plus administrative costs; Rita acknowledged the ruling in the hearing record but did not produce the contractor to testify.
