Engineer Chris Terrizzi asked the Town Board for relief from Town Code Section 130‑14.16, which limits private roads to four lots, for the proposed Mitchell 7‑lot subdivision at 1559 Route 9W.
Terrizzi explained that two lots have secondary access and are therefore exempt from the private‑road limit, and that five lots would otherwise be accessed via a private road. The Town Highway Superintendent reviewed the proposal and concluded the road is not suitable to be accepted as a Town road. Council members raised concerns about the history of private‑road maintenance agreements, confusion among buyers about obligations, and the road’s grade and placement. Councilman Zambito recommended a physical site review; the Board agreed to schedule a site visit to assess road conditions before taking action on the variance request.
No formal waiver was granted at the meeting; the Board treated the matter as an active Planning Board application and will use the site visit to inform any future vote.
